Rules on the purchase and sale of goods
1. General provisions
1.1 These E-shop Rules (hereinafter referred to as the "Rules") are a legally binding document for the Buyer and the Seller (hereinafter referred to as the "Seller"), which sets out the rights and obligations of the Parties.
1.2 The Seller reserves the right to change, modify or amend these Rules at any time. The Buyer shall be informed of any changes to the Terms and Conditions on the website of the e-shop.
2. Conclusion of the sale and purchase agreement
2.1 The contract of sale between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the goods in the online shop, having first read these Rules.
3. Seller's rights
3.1 In the event of serious circumstances, the Seller may temporarily or permanently suspend the operation of the online shop without prior notice to the Buyer.
3.2 If the Buyer attempts to undermine the operation, stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend his/her access to the online shop without notice.
4. Obligations of the Seller
4.1 The Seller undertakes to make available the services of the online shop, the conditions of operation of which are set out in these Terms and Conditions.
4.2 The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, in accordance with the conditions laid down in these Terms and Conditions.
4.3 Where, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online shop, the Seller shall have the right to terminate the Purchase and Sale Contract by informing the Buyer in advance. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 3 working days.
4.4. If the Buyer exercises the right provided for in Clause 5.2 of the Terms and Conditions, the Seller undertakes to refund the money paid to the Buyer within 5 (five) working days from the date of receipt of the returned goods.
4.5 The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller or until the Buyer has provided proof that the Goods have been dispatched to the Seller, whichever is the earlier.
5. Buyer's rights
5.1 The Buyer shall have the right to purchase goods in the e-shop in accordance with these Terms and Conditions.
5.2 The Buyer shall have the right to withdraw from the contract for the purchase of goods concluded in the e-shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3.The Buyer may only exercise the Buyer's right as set out in Clause 5.2, provided that the goods have not been damaged or substantially altered in appearance, and that they have not been subjected to use.
6. Obligations of the Buyer
6.1 The Buyer shall pay for the goods purchased and accept them in accordance with the procedures set out in these Conditions.
6.2 If the Buyer refuses to accept the goods at the time of delivery without good reason, the Buyer shall be liable to pay the cost of returning the goods upon the Seller's request.
6.3 At the time of delivery of the goods to the Buyer, the Buyer must check the condition of the consignment and the goods(s) with the Seller or the person delivering the consignment.
6.4 By using the online shop, the Buyer confirms that he/she agrees to and is obliged to abide by these Terms and Conditions of Purchase.
7. Commodity prices
7.1 The prices of the goods in the online shop shall be quoted in euros. Prices are inclusive of VAT. Once the order has been confirmed, delivery charges, if any, shall be added to the total amount of the goods.
8. Ordering and payment of goods
8.1 The Customer shall, after visiting the online shop, select the goods he/she likes and place them in the shopping cart. After the shopping cart has been created, the Buyer shall enter the personal data necessary for the execution of the order: his/her name, surname, the address to which the goods will be delivered, telephone number and any additional information that may be relevant for the delivery of the goods ordered. The Buyer acknowledges that he/she has read these Terms and Conditions and confirms the order.
8.2. Payments can be made in Euro currency. Payments are processed using the MakeCommerce.lt payment platform.
9. Delivery of goods
9.1 When ordering the Goods, the Buyer must specify the exact address for delivery of the Goods.
9.2 The Buyer must take delivery of the Goods himself. If the Buyer is unable to take delivery of the goods himself, but the goods are delivered to the address specified by the Buyer, the Buyer shall not be entitled to make any claim in respect of the delivery of the goods to an unsuitable person.
9.3 The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods.
9.4 The characteristics of all goods sold shall be set out in a description attached to the goods. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.
10. Returning goods
10.1 Goods of good quality may be returned within 14 days of receipt. The defects of goods sold in poor quality shall be eliminated, the poor quality goods shall be replaced and the goods shall be returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2.When returning goods, the following conditions must be observed:10.2.1. The returned goods must be in their original packaging in good condition (this point does not apply in the case of the return of low-quality goods);
10.2.2.The goods must be undamaged by the Buyer;
10.2.3.The goods must be unused, without loss of merchandise appearance: labels must not be damaged, protective films must not have been torn off etc.
10.2.4. the returned goods must be in the same condition as received by the Buyer (this clause does not apply in case of return of low-quality goods);
10.2.5. the Seller has the right to refuse to accept the Buyer's returned goods, if the conditions of the return of the goods have not been complied with;
10.2.6. Returns shall be made in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in the case of low-quality goods, in which case returns shall be made within the statutory warranty period);
10.3. Returns and replacements of goods of satisfactory quality shall be made in accordance with Article 6.22810(1) of the Civil Code;
10.4. The money paid for the goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer's account no later than within 5 (five) days from the date of the return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.
11. Baigiamosios nuostatos
11.1 These Terms and Conditions are made in accordance with the laws of the Republic of Lithuania.
11.2 These Terms and Conditions and the relationship between the Parties hereto shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3 Any disagreements arising out of the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4 The Parties shall be excused from the performance of their obligations under these Terms and Conditions if such performance is prevented due to unforeseeable circumstances beyond the control of the Parties (Force major).
